83rd District Court sentencing

• James Edward Fierro, DOB: June 8, 1994, (P-3329-83-CR): Plead guilty to burglary charges and sentenced to 10 years in penitentiary. As part of plea, also plead guilty to felony charges in the 83rd District Court of Arson of a Habitation (P-3469-83-CR) and Continuous Violence Against Family (P-3468-83-CR) and misdemeanor charges in Pecos County Court of Driving While Intoxicated (CR-22507), Duty Striking Fixture/HWY Landscape (CR-22506), Criminal Trespass (CR-22580), Criminal Mischief (CR-22581), Unlawful Restraint (CR-22622), Theft of Property (CR-22813), Violation of Protective Order (No. 22814) and Criminal Mischief (No. 22486).

Here is the sentencing update from the March 6, 2019 session of the 83rd District Court:

• Danny André Dixon (P-3430-83-CR) Sexual Assault of a Minor Under Age 17; (P-3431-83-CR) Online Solicitation of Minor; (P-3432-83-CR) Indency with a minor: Filed a motion to suppress evidence. Set for April 3: Judge Stephen Ables to hear motion to recuse first via phone, and after the ruling by Judge Ables, the motion to suppress.

• Andrea Marie Rivas (P-3128-83-CR): Motioned filed by state to revoke probation from May 14, 2014 conviction for Aggravated Assault (Deadly Weapon). Raised defendants bond to $100,000 and reset case for April 3, 2019 at 9 a.m.

• Benny Avery Lopez-Molina (P-3247-83-CR): Sentenced to 30 days in the Pecos County Jail and community supervision extended by an additional two years for DWI arrest in El Paso County while on probation for Unlawfully Carrying a Weapon.

As part of plea, also plead guilty to felony charges in the 83rd District Court of Arson of a Habitation (P-3469-83-CR) and Continuous Violence Against Family (P-3468-83-CR) and misdemeanor charges in Pecos County Court of Driving While Intoxicated (CR-22507), Duty Striking Fixture/HWY Landscape (CR-22506), Criminal Trespass (CR-22580), Criminal Mischief (CR-22581), Unlawful Restraint (CR-22622), Theft of Property (CR-22813), Violation of Protective Order (No. 22814) and Criminal Mischief (No. 22486).

• Sally Jeanette Garcia (P-3332-83-CR): Sentenced to 6 months in state jail facility for violation of parole on sentence from Possession of Controlled Substance.

• Richard A. Fernandez Jr. (P-3411-83-CR): Placed on two years deferred adjudication probation and ordered to pay a $1,000 fine, restitution of $180 and $309 in court costs for Possession of Controlled Substance.

• Marshall Alexander Smith (P-3452-83-CR): Placed on three years deferred adjudication probation and ordered to pay a $1,000 fine, lab fee of $180 and $324 in court costs for Possession of Controlled Substance.

• Noemi Rivera Ramirez (P-3454-83-CR): Warrant for arrest and bond raised to $100,000 after not appearing in court on charges of Prohibited Substances and Items in Correctional Facility.

• Marco Antonio Diaz (P-3457-83-CR): Placed on three years probation and ordered to pay $1,000 fine, court costs of $324 and sentenced to 10 days in jail for Driving While Intoxicated 3rd offense or more.

• Diana Carrasco (P-3474-83-CR): Voluntary agreed to enter into pre-trial intervention program for 1 year, pay program fee of $500 and pay $60 per month probation fee for 12 months and pay fee of $180 to Texas DPS for Lab Fees. Case set for review in one year for Possession of Controlled Substance.

• Jamie Albert Primera (P-3480-83-CR): Sentenced to 10 years in penitentiary for forgery. As part of plea, plead guilty to (P-3479-83 CR) Possession of Controlled Substance; (P-3481-83-CR) Unauthorized Use of a Motor Vehicle.

• Mario Palacios Jr. (P-3482-83-CR): Filed waiver of arraignment and entered “not guilt” plea. Pretrial hearing set for April 3, 2019.

• Oscar Blanco Ramirez (P-3486-83-CR): Sentenced to 10 years for possession of controlled substance, 8 years probation, $1,000 fine, $309 court costs and $180 lab fees.
